The Public Procurement Act 2006 has been amended in 2021 to enable public officials/bodies to disclose information on bids / bid proceedings to the Competition Commission. The amendment was brought to ‘Section 51 (1) (e) of PPA 2006 – Conduct of public official’ via section 73 of the Financial (Miscellaneous Provisions) Act 2021. Thus, public officials/bodies are specifically allowed to disclose information on bids / bid proceedings without the requirement of a Court order, “where disclosure is required by an investigatory body vested with powers of investigation, including the Independent Commission against Corruption, Competition Commission or Police”.
