Don’t risk the Penalty – Apply for Amnesty

Beginning 25 May 2026 and until 25 November 2026, the Competition Commission is offering a unique opportunity to trade associations (including professional bodies), cooperatives and their members to apply for amnesty under TACAP and stand to benefit from complete immunity from fines.

TACAP is a one-off amnesty programme put in place under the Competition Commission (Trade Association and Cooperatives Amnesty Programme) Regulations 2026 (‘the Regulations’), made under section 72 of the Competition Act. The programme incentivizes trade associations and cooperatives to voluntarily disclose, with supporting information, certain types of cartels and to cooperate fully in view of ceasing such conducts and ensuring compliance with the law going forward.

TACAP is only open to trade associations, cooperatives and their members (past and present) for their involvement in collusive conduct that is capable of qualifying as horizontal collusive agreement or bid rigging.  These conducts are respectively prohibited under Section 41 and Section 42 of the Competition Act.  For purposes of TACAP, applicants are, however, not required to admit liability under any of those provisions of the Act.

The Regulations clearly specify the conditions attached to TACAP and which must be fulfilled by TACAP applicants. In this respect, all mandatory documents prescribed in the Regulations have been published to assist applicants in navigating TACAP.  Additional guidance documents have also been prepared to assist interested persons in better understanding the different aspects of the programme.
